Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Kind Day mobile application ("App," "Service," or "Kind Day").

1. Acceptance of Terms

By downloading, installing, or using Kind Day, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Description of Service

Kind Day is a habit tracking application that helps users build positive habits and break negative ones. The Service includes:

• Free Plan: Track up to 3 habits with basic features
• Premium Plan: Unlimited habits, advanced insights, and premium features via subscription

3. Account and Authentication

3.1 Anonymous Accounts

• Kind Day automatically creates an anonymous account using Firebase Authentication when you first use the App.
• No email, password, or personal information is required to use the basic features.

3.2 User Responsibility

• You are responsible for maintaining the security of your device.
• We use device-specific authentication tokens to identify your account across devices.
• If you uninstall the app without syncing data, your local data will be lost.

3.3 Account Termination

• You may delete your account by contacting hello@kindday.site.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

4.1 Premium Subscription

• Price: $4.99 USD per month (or equivalent in your local currency)
• Billing: Charged monthly to your Google Play or Apple App Store account
• Auto-Renewal: Automatically renews unless canceled at least 24 hours before the end of the current period
• Feature Access: Unlocks unlimited habits, advanced insights, and all premium features

4.2 Payment Processing

• All payments are processed through Google Play Store (Android) or Apple App Store (iOS).
• We use secure server-side validation with Google Play Billing API and Apple StoreKit to verify purchases.
• Your payment information is handled entirely by Google or Apple—we do not store credit card details.

4.3 Refunds

• Refunds are handled according to Google Play's refund policy or Apple's refund policy.
• Contact the respective store for refund requests.
• We do not process direct refunds.

4.4 Cancellation

You can cancel your subscription anytime through:

• Android: Google Play Store → Subscriptions
• iOS: Settings → Apple ID → Subscriptions

Cancellation takes effect at the end of the current billing period. You retain premium access until the subscription expires.

4.5 Price Changes

• We may change subscription prices with 30 days' notice.
• Changes apply to new subscriptions or renewals after the notice period.

5. User Content and Data

5.1 Your Data

• You retain ownership of all habit data, notes, photos, and content you create in Kind Day.
• By using the App, you grant us a license to store and process your data to provide the Service.
• Photo Uploads: You may optionally upload photos to personalize your habits. You are solely responsible for the content of photos you upload and must ensure they do not violate any laws or third-party rights.

5.2 Data Synchronization

• Your subscription status is synchronized across devices using Google Cloud Firestore.
• Habit data is stored locally on your device with cloud backup available for Premium users (future feature).

5.3 Data Backup

• We automatically backup your subscription data in the cloud.
• Local habit data is your responsibility to backup.

5.4 Data Deletion

• Deleting the App removes local data (including habit data and photos) immediately.
• To delete cloud data (including uploaded photos), email hello@kindday.site.

6. Prohibited Conduct

You agree NOT to:

• Use the App for illegal purposes
• Upload photos containing illegal, offensive, or inappropriate content
• Attempt to reverse engineer, hack, or exploit the App
• Share or resell your premium subscription
• Use automated tools to manipulate habit data
• Violate any laws or regulations
• Harass, abuse, or harm other users (if social features are added)

7. Intellectual Property

7.1 Ownership

• Kind Day, including all code, design, and content, is owned by us and protected by copyright, trademark, and other laws.
• You may not copy, modify, distribute, or create derivative works without permission.

7.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to use Kind Day for personal, non-commercial purposes.

8. Disclaimers and Limitations of Liability

8.1 "As-Is" Service

• Kind Day is provided "AS IS" without warranties of any kind.
• We do not guarantee the App will be error-free, secure, or always available.

8.2 No Medical Advice

• Kind Day is for informational and motivational purposes only.
• It is NOT a substitute for professional medical, psychological, or health advice.

8.3 Limitation of Liability

9. Third-Party Services

Kind Day integrates with:

• Firebase (Google Cloud): For backend services (Terms)
• Google Play Billing: For Android subscriptions (Terms)
• Apple In-App Purchase: For iOS subscriptions (Terms)

You agree to their respective terms when using these services.

10. Privacy

Your use of Kind Day is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.

11. Changes to Terms

We may update these Terms periodically. Changes will be posted on this page with an updated "Last updated" date. Continued use after changes constitutes acceptance.

For material changes, we will notify you via:

• In-app notification
• Email (if we have your email)
• Announcement on our website

12. Governing Law

These Terms are governed by the laws of Brazil.

Disputes will be resolved in the courts of Brazil.

For EU users, your rights under GDPR are preserved.

13. Dispute Resolution

13.1 Informal Resolution

Before filing a claim, contact us at hello@kindday.site to resolve the issue informally.

14. Severability

If any provision of these Terms is found invalid, the remaining provisions remain in effect.
